On the territory of all Russian regions, with the exception of Sevastopol, from this year the tax on personal property of individuals will be formed in a new way - based on the cadastral value of the object. This means that the previously used inventory value of objects will not be involved in calculating tax payments in 2021.

New rules for calculating tax deductions

Accounting for the cadastral value of an object in calculating payments is regulated by Russian tax legislation (clause 1 of Article 402 of the Tax Code of the Russian Federation). In rare cases, the indicator is not taken into account if in certain regions of the country the corresponding normative document has not been adopted, confirming the application of this parameter in calculating tax payments.

The new calculation rules came into force gradually. The list of Russian regions that switched to using the cadastral value in determining the size of the tax was replenished in stages.

To prevent a sharp increase in the level of burden on the payer in 2021, Russian legislation provides for a number of measures. In the course of calculating the personal property tax of individuals, several rules apply:

  1. You can draw up a tax deduction for a residential building, apartment or room at the cadastral value - 50, 20 and 10 square meters from the specified types of real estate, respectively.
  2. If there are three or more minors in the family, you can get increased tax deductions in the form of square meters: 7 - if you own a residential building, 5 - if you own an apartment.
  3. For the first three years, reduction factors are provided: 0, 2, 0, 4 and 0, 6 from the first to the third year, respectively.
  4. After two years, the tax cannot be increased by more than 10 percent, except for retail and office premises.
  5. A number of categories of people have been identified who can enjoy benefits - not to pay tax on one of the types of existing real estate. You don't have to pay for one apartment, one garage or one room. An exception is objects that are used in the business sphere.

If only part of the property is owned, then the owner must pay tax payment only for his share. It is important to know that all the established benefits for the current period remain even with the transition to a new system for calculating tax payments. Local tax authorities determine the amount of the payment.

Individual property tax rates

In the process of forming the amount of payment, the cadastral value indicator posted in the USRN on January 1 of that year, which is the tax period, is used. The provided tax deduction is subtracted from the cadastral value and multiplied by the rate. The percentages that will be in effect in 2021 are presented in the table below.

Tax payment deadline

According to article 409 of the Tax Code of the Russian Federation, the payer must pay the tax before December 1 of the year that follows the previous tax period. The tax office sends a notification to the citizen, on the basis of which the payment is made.

The cadastral value is a more reliable indicator of the assessment of real estate of individuals, which is established as a result of an examination. The transfer of real estate tax, taking into account the cadastral value, will take place for the first time in 2021.
