The law on silence is unique for each region, and in the Moscow region in 2021 it has not changed. The last corrections were made in April 2020, due to the spread of coronavirus infection. Basically, the rules have remained the same, but there are nuances that should not be forgotten.

Silence Law Requirements

In the Russian Federation, the norms of silence are regulated by Federal Law No. 52 "On the Sanitary and Epidemiological Welfare of the Population." But each region introduces its own clarifications to it in a separate document. At the same time, different rules apply for Moscow and the region.

In the Moscow region, noise issues are regulated by the Law of the Moscow Region No. 16 / 2014-03 "On Ensuring Peace and Peace of Citizens in the Territory of the Moscow Region." So, according to this document, you cannot make noise at night and from 13 to 15 every day.

Daytime restrictions apply only to loud music, as well as repair work inside houses, but not on adjoining territories or summer cottages. At the same time, on the street you can sing, play the guitar, blow up firecrackers or calmly unload building materials and furniture. This will not be punished.

However, it should be borne in mind that for the period of introduction of the restriction due to coronavirus infection, other, more stringent requirements for silence for builders were introduced. You must not make noise:

  • from 19:00 to 9:00 on weekdays;
  • from 19:00 to 10:00 on Saturday and holidays;
  • daily from 11:00 to 17:00;
  • all day Sunday.

This only applies to renovations in apartment buildings. The requirements apply both to construction noise inside the apartment and to work in the entrances and stairwells.

What counts as noise

There are 2 official documents that regulate the issue of permissible noise standards:

  1. SanPiN 2.1.2.1002-00.
  2. Sanitary norms СН 2.2.4 / 2.1.8.562-96.

If we simplify the norms set out in them a little, it turns out that in the daytime in apartments you can make noise up to 55 dBA, and at night - up to 40 dBA. On the adjoining territory - 70 dBA and 60 dBA, respectively. Of course, few people have a special device to measure decibels. To understand the noise level, you need to focus on the following data:

  • 30 dBA - quiet muffled conversation, computer noise;
  • 40 dBA - the noise of the refrigerator, everyday speech;
  • 50 dBA - the sound of a typewriter or boiling kettle;
  • 60 dBA - communication at raised tones, TV sound at medium volume;
  • 70 dBA - the noise of an old (Soviet) vacuum cleaner, sounds during a quarrel;
  • 80 dBA - cry of a baby, noise of cars on the Moscow Ring Road.

Much depends on the soundproofing of the premises. Therefore, in some houses even the noise of a hammer drill (130 dBA) can be relatively comfortable for neighbors, and in some rooms even a whisper can be heard on 3-4 floors.

However, not all noise is subject to legal restrictions. You don't have to worry about the reaction of neighbors and fines in such cases:

  • emergency situation and work to eliminate it;
  • alarm triggering, including accidental;
  • prevention of offenses.

Cleaning work on adjoining territories, officially registered concerts, sports and social events are not considered noise and you just have to endure them by tightly closing the windows. Also, a person at home can calmly cough loudly, sneeze and snore at any time.

How to deal with noise and where to complain

Always start with a dialogue first. In most cases, this is already enough to settle the issue. But it is important to refrain from obscene language and insults.

If the interlocutor refuses to comply with the silence regime, it is worth reminding him of the administrative responsibility for violating the law. But there are times when conversations are useless and it's time to make a decision, complain about loud neighbors.

First of all, you need to make an audio or video recording on which noise will be clearly heard. It is best if you can use a volume meter and record it on video.

Then you can contact one of three authorities:

  1. The police. A district or duty outfit is the best option to calm down a noisy party. Audio and video in this case will help to prove that there was a noise, if suddenly the perpetrators by the time of the arrival of the law enforcement officers have already calmed down.
  2. Homeowners' association or management company. Employees of these organizations will help to deal with both neighbors and owners of sports clubs, cafes and shops who do not comply with the law on silence.
  3. Rospotrebnadzor. When applying for constant noise, specialists will come and measure its level with their equipment, draw up an act. In the future, Rospotrebnadzor employees will also help convince neighbors not to make noise.

If none of the three options work, the last resort is court. But it is worthwhile to prepare in advance a substantial evidence base: expert reports, testimonies of neighbors, audio and video materials, in order to bring violators to justice.

Punishment for noise in the Moscow region in 2021

At the first complaint, law enforcement agencies try to limit themselves to a warning, but then they can take more serious measures. For violation of the silence, a fine is provided:

  1. For individuals, the first violation will result in a punishment of 1,500-3,000 rubles. For the second time, the fine will be already 4 thousand rubles. Further, the amount is fixed at 5 thousand rubles.
  2. For officials, the penalty for noise is higher: 5 thousand-10 thousand rubles, 15 thousand-30 thousand rubles. and 50 thousand rubles. respectively.
  3. For legal entities, the fines are even higher. At the first violation of the law - 20 thousand - 50 thousand rubles. Next time - 60 thousand - 80 thousand rubles, and for subsequent violations - 100 thousand - 150 thousand rubles.

Given that the fines are quite large, in most cases the perpetrators try to comply with the rules and not violate the law on silence in the Moscow region in 2021.
