Production calendar 2021 with holidays and weekends

The production calendar is a special document drawn up on the basis of the regular calendar for 2021 and approved by the Decree of the Government of Russia. It is compiled with holidays and weekends on the basis of the Labor Code of the Russian Federation, working days and hours.

What is it and by whom is it compiled

Each year, on the basis of the usual, with months and days, a production calendar is drawn up with working days, holidays and weekends. In the Russian Federation, it is being developed and approved by three stakeholders: the Ministry of Labor and Social Protection, trade unions and the Association of Russian Employers.

The production calendar for 2021, already approved by the Prime Minister of Russia and published, was formed taking into account the labor legislation, the Constitution of the Russian Federation, the resolution of the Cabinet of Ministers on the postponement of the weekend and the Order of the Ministry of Health and Social Development No. 588 "On the approval of the procedure for calculating the norm of working hours …" and serves various purposes.

The Cabinet of Ministers signs an option agreed with all parties to the labor process and meeting all the requirements of regulatory documents. Only the production calendar approved by the Cabinet of Ministers has a legal status:

• with the norms of working hours for each month of the current year and for 2021 as a whole, established on the basis of the labor legislation of the country;
• with holidays and weekends, transfers, which should compensate citizens for legal non-working hours, if the federal holiday coincides with a regular weekend;
• discussed and agreed with all parties;
• signed by the prime minister and published on the official website of legal documents.

Despite the absence of a term in official legislation and the presence of other definitions (time sheet, work, labor calendar), it is he who is necessary for the full implementation of the labor process, in demand by representatives of different professions and ordinary citizens.

What this document is used for

The production calendar is drawn up in accordance with the constitutionally guaranteed right to rest and the legislation that determines the dates of federal significance. After optimizing the production cycle and providing citizens with holidays and weekends, this calendar can be used in work:

• employees of the accounting department of the enterprise for calculating the salaries of employees;
• employees of the personnel department to determine the time of the statutory vacation;
• employers and managers for drawing up work schedules at enterprises of any form of ownership;
• ordinary citizens who want to know the weekend schedule or check the correctness of payroll.

The approved calendar contains information to help you calculate and plan working hours and rest days. They are grouped by quarter, monthly, with all holidays and weekends, shortened working days due to federal statutory dates.

Some regions may have their own special dates on which rest is relied on (a day of a subject of the Federation or a religious holiday). In this case, it makes sense to use the option adjusted by the regional authorities in everyday work.

The production calendar in Russia is usually calculated on a 40-hour work week, which assumes that a person works 8 hours a week. The figure in the table is obtained by multiplying 8 hours by the number of working days. Then 6 hours are taken away, by which the working days before the federal holiday are shortened.

Weekends and holidays in the country

There are public holidays in Russia, which, according to the current legislation, are accepted as weekends. In fact, there are many more of them. There are only a few dozen professional holidays celebrated throughout the country. But they are not enshrined in the Labor Code or are traditionally celebrated on Sunday. These are such holidays as the Day of the Medic and the Day of the Navy.

Changes in the procedure for celebrating state dates occur only after the relevant government decree on its establishment and another one on amendments to the current legislation of the Russian Federation is issued.

This was the case with the New Year holidays in due time, thanks to which the working people have the opportunity to additionally rest on these holidays. And December 31 can be a day off only if it is Saturday or Sunday, or if the Cabinet has approved the transfer of another holiday to this day. It has no statutory holiday status.

The calendar was approved on the basis of Art. 112 of the Labor Code of Russia, entitled "Non-working and holidays". A shorter working day before the holiday is established on the basis of Part 1 of Art. 95 of the Labor Code of the Russian Federation.

Article 113 of the Labor Code prohibits work on holidays and weekends if it is not performed on a watch basis or according to a separately drawn up schedule, which provides for days of rest. If a person works for production needs, he is paid double the amount.

Procedure for using a published document

The rates of working hours indicated in the production calendar for 2021 are used by the accounting department for calculating wages and determining overtime hours worked. If a person has not completed the number of hours prescribed in a month, he may be charged less than the salary required under the labor agreement and even less than the minimum wage.

The minimum salary is paid, provided that the required number of hours in a month has been worked. Overtime is paid to an employee at one and a half and double rates, but cannot exceed 120 hours per year. This provision is established by labor legislation.

All the actual data that are given in the production calendar in terms of the number of days in a year and their arrangement by day of the week are taken from the regular calendar. Working hours, holidays, weekends and pre-holidays are determined on the basis of federal and regional legislation, the Labor Code and a resolution of the Cabinet of Ministers.

The labor calendar with holidays and days off, approved at the legislative level, is a fundamental document for drawing up a work schedule. All time that is overworked in a particular month must be paid at an increased rate.
