On April 2, the President of Russia addressed the citizens of the country with another statement, according to which the self-isolation regime will be maintained until April 30 inclusive. It is strictly forbidden to go to work during this period. However, a list of enterprises that will still work in quarantine has been approved.

The legislative framework

According to the Presidential Decrees of March 25, 2020 N 206, of April 2, 2020 No. 239, the period from March 30 to April 30 inclusive is declared inoperative. For most entrepreneurs and organizations, this means that they should temporarily suspend their activities.

At the same time, someone needs to provide the population of the country with basic necessities, food, utilities, communications and others. For this reason, the list of enterprises that will work in quarantine has been approved in accordance with clause 2 of the Presidential Decree No. 206 of March 25, 2020.

List of organizations

As of today, the list of enterprises has been clearly defined, which will function in the previous regime, but with a number of restrictions. If we refer to the recommendations of the Ministry of Labor and Social Protection of Russia, then during the quarantine period, employees have the right to work:

1. Pharmacies, medical organizations, enterprises that are responsible for maintaining their continuous technological activities, social service organizations.
2. Enterprises that carry out continuous activities and cannot suspend it due to the specifics of production and technical conditions. This also includes companies involved in water treatment, heating and energy.
3. Organizations working with hazardous production facilities under continuous government supervision. We are talking about companies providing industrial safety.
4. Enterprises responsible for the operation of hydraulic equipment.
5. Nuclear industry enterprises.
6. Construction companies whose quarantine would endanger the health and safety of people.
7. Agricultural enterprises engaged in spring sowing work.
8. Organizations responsible for supplying the population of the country with essential goods and food.
9. Firms specializing in warehouse and transport services. This refers to organizations that interact with enterprises working in the field of supplying the population with essential goods and products.

The list of enterprises that will work in quarantine can be continued by trade organizations, firms specializing in urgent work in emergency situations. And also manufacturers of disinfectants, medicines, medical devices, thermal imagers, equipment for air disinfection, supplying components for the production of all these goods.

What other businesses will be quarantined? Of course, those that protect the population from the spread of coronavirus infection and generally protect the health of the population will continue to function.

The list is also supplemented by companies:

• responsible for working with industrial waste;
• supporting housing and communal services for Russians;
• working with oil products supply systems;
• the financial industry, namely those that are entrusted with urgent functions;
• engaged in transport services to the population;
• employed in the field of urgent work on repairs, loading and unloading, etc.

The Pension Fund of the Russian Federation, as well as its regional branches, will continue to work. The employees of the department ensure the timely receipt of social payments and pensions.

This also applies to the Social Insurance Fund. It will pay cash payments to people who face temporary disability due to the birth of a child, due to problems at work or in the event of occupational diseases. The work of the Federal Compulsory Medical Insurance Fund will also continue.

Who will determine the number of employees

This function is entrusted to the heads of federal state bodies, as well as heads of bodies of the constituent entities of the Russian Federation, governing bodies of local self-government and, finally, directors and heads of industrial enterprises. They will determine the number of employees from among those who ensure the maintenance of the functioning of these organizations, including remotely.

The same persons will independently determine the number of employees and employees for whom the non-working period has been approved. The corresponding decision must be supported by an order.

Will stores retain the right to work in quarantine?

Those shops that offer essential goods and food are allowed to work during the period of high readiness. This right is assigned to them in accordance with paragraph 2 of the Presidential Decree No. 206 of March 25, 2020.

Which organizations cannot work

Any enterprises, companies, with the exception of the above, should be closed from March 30 to April 30. If it is found that they, bypassing the decree, decided to return to their usual mode of activity, such organizations will be issued administrative fines.

Unscheduled inspections can also be scheduled. To avoid negative consequences, it is necessary, if possible, to transfer employees to remote work.

How will the quarantine period be paid?

The Ministry of Labor gave an explanation of how the period of forced isolation of employees of an enterprise not included in the reviewed list should be paid. The department said that non-working days in March and April are not grounds for lowering wages.

But you shouldn't expect an increase in their level either, since these days are not actually officially taken days off. Also, they are not classified as non-working holidays.

If an employee is on vacation during the officially approved quarantine period, then these days are not included in the number of vacation days, respectively, the vacation for the specified time will not be extended. The measures taken apply to all regions of the Russian Federation.
