The coronavirus pandemic has been going on for more than a year, and most scientists agree that total vaccination is the only possible way to stop the spread of a dangerous pathogen. Immunization is a great discovery of mankind, with the help of which it was possible to get rid of many infections. However, there are people who do not want to be vaccinated in principle, looking for ways to avoid being vaccinated against coronavirus in Russia.

Three coronavirus vaccines have already been registered in Russia, and they are all of a different type. The world community not only buys drugs developed by Russian scientists, but also opens their production on its territory.

Earlier, in the instructions for refusal, it was suggested not only to refer to article of law No. 157 (dated September 17, 1998), but also to the fact that vaccinations against coronavirus are not on the mandatory calendar.

Now citizens do not have this opportunity. In the Order of the Ministry of Health No. 125n (dated March 21, 2014), a new vaccination schedule was approved, with mandatory injections from COVID-19.

The ability to appeal to the first part of Art. 2 of the Federal Law remained theoretically. But changes appeared in the same law: Part 3 of Art. 10 indicates the need for mandatory vaccination of citizens from priority categories.

Legislative basis

S. Swaminathan, WHO staff member, said that the health and education sectors are considered priority occupations for priority vaccination worldwide. This is the only common point, otherwise the countries decide such issues based on the specifics of their legislation.

The list of people who undergo priority vaccination is enshrined in a government decree adopted more than 20 years ago, when no one had ever suspected about a new type of pathogen. There is a later regulatory legal act - Law No. 323 (dated November 21, 2011), which states that the drug can be administered only after the patient's written consent. But only a person whose profession is not included in the listed risk groups can refuse vaccination at work.

There are three categories of citizens whose vaccination is on the priority list:

• doctors and teachers, since they are in contact with direct sources of infection;
• security officials and army employees, students, people working on a rotational basis, public transport drivers, volunteers and civil servants who are constantly in crowded places;
• patients whose diseases suggest weakening of the immune system, therefore, the coronavirus infection is severe in them.

In theory, people on the priority list could opt out of compulsory vaccine administration, but they must have a compelling reason, stipulated in regulations or laws, to do so. Otherwise, not very good consequences are quite likely. You should not look for a way to avoid vaccination against coronavirus in Russia, be afraid of complications, do not consider coronavirus infection a dangerous disease.

Reasons for refusal

Appealing to the legal right of every citizen to refuse to administer the vaccine, a person whose work activity involves compulsory immunization may be suspended from work until the presentation of a voucher or a certificate of vaccination. A citizen can contact the supervisory authorities to clarify whether his occupation is included in the priority list.

A physician need not ask for such clarification, as well as a military man and a teacher. Representatives of other professions can try to file a complaint with the prosecutor's office, the Labor Inspectorate.

Social workers, medical workers and teachers will not be subject to disciplinary punishment, because it is illegal, but suspension from work and temporary leave without pay is a very real measure. The only legitimate reason in this case is to be left without income and means of subsistence or to change the type of activity, to look for another one in which there are no such requirements.

Medical indications are the only legal basis for refusing the Covid-19 vaccine.

Registration of refusal

The rules on how to file a refusal to vaccinate against coronavirus are simple. You need to write a statement. It is imperative to indicate in it the full name, year of birth, place of residence, contact phone number and the name of the vaccine that you refuse. Lawyers advise to indicate that this is done on the basis of the law, and to hand the application to the employer who insists on vaccination.

Representatives of professions from the priority list can avoid the consequences of refusal only on the basis of medical indications: pregnancy and breastfeeding, ARVI or other respiratory disease, exacerbation of gastrointestinal diseases. All the rest (coronary artery disease, epilepsy, allergies, asthma, endocrinology) are called undesirable, but immunization with them is possible subject to certain conditions.

The coronavirus vaccine is the only way to stop the pandemic of this disease. The Russian government provides free vaccination on a voluntary basis, but there are professions that imply mandatory vaccination of employees.
