Although in the legislation of the Russian Federation the concept of "maternity benefits" is absent, in Russia a decree means maternity leave, which is issued on the basis of a sick leave. In 2021, the amount of compensation for the first child is calculated depending on the level of wages, but cannot exceed the maximum established by law.
The procedure for assigning subsidies
According to the established rule, maternity benefits are calculated by the employer.
The exception is the regions where the pilot project "Direct payments" was launched, which involves receiving financial assistance directly from the FSS treasury.
In any case, the application and all accompanying documentation are submitted to the accounting department at the place of work.
BiR benefit is issued from the 30th week of pregnancy, a lump sum payment is made for the entire vacation period.
Its duration, as a rule, is 140 days, but in some cases it can be increased to 156 days (in case of childbirth with complications) or up to 194 days (in case of multiple pregnancies).
What documents will be required

All documentation can be delivered in person, via the Internet, or use the services of the Russian Post. In the latter case, only certified copies (without originals) are sent.
Terms of calculating benefits
The terms for applying for the appointment of payment are limited to a period of 6 months from the end of the vacation in the BiR.
The allowance is calculated within 10 days after the policyholder receives all the necessary documents. If the payment is made by the social security authorities, the funds are sent by postal order or credited to the recipient's card no later than the 26th day of the month following the month of appeal. The amount of the maternity allowance

You can calculate the amount using the formula:
Average salary for 731 days (leap year 2020) * number of days of maternity leave (usually 140 days) = BiR subsidy.
At the same time, one should take into account the fact that the salary includes all payments that a woman received during the billing period.
The maximum amount that an employee will receive cannot be higher than the average daily earnings. In 2020, this amount was 322,191 rubles (calculated taking into account the maximum amount of contributions to the Social Insurance Fund).
The size of the minimum payment depends on the size of the minimum wage and is 55,830 rubles.
The amount of the subsidy may be below the minimum level if the employee worked part-time.
Also, a woman who worked for less than six months before going on maternity leave can count on an amount that does not exceed the minimum wage for a full calendar month.
If the employee continues to work after 30 weeks of pregnancy, she cannot receive both wages and BIR benefits at the same time. The payment will be calculated later and only for those days that the pregnant woman was actually on maternity leave.
The calculation does not take into account the periods when the woman did not work:
- full or partial release of the employee from the performance of labor duties with the preservation of earnings, if these days were not included in the calculation when calculating insurance premiums;
- Holiday to care for the child;
- maternity leave;
- termination of work due to illness.
Who is eligible for BiR benefits?
Women can count on state support in such a crucial period:
- Employed by an enterprise / organization of any form of ownership.
- Full-time students in educational institutions. The responsibility for calculating the allowance lies with the administration of the educational institution. The amount paid is equal to the amount of the scholarship.
- Dismissed in connection with the termination of the activity of the individual entrepreneur or the liquidation of the enterprise. In this case, a woman can apply to the social security authorities for the appointment of a payment within 12 months from the date of her recognition as unemployed.
- Military personnel under contract. Payment is made at the place of service.
What other payments are due
In addition to the main BIR allowance, the mother (or the father at the place of employment) can hope to receive a one-time compensation for the birth of a child in the amount of 18,144 rubles. And also for the additional allowance, which is due to women registered with antenatal clinics in the early stages of pregnancy (the first 12 weeks) - 680 rubles.
In some regions, an increase in compensation payments is provided due to the regional coefficient. But it should be understood that this increase does not apply to accruals to the list of temporary disability, since in this case the size of the salary is taken into account.
Allowance for the unemployed is drawn up in the social security authorities at the place of residence.
If a pregnant woman is not officially employed, she can hope to receive only the following types of subsidies:
- compensation payment for registration in a medical institution up to 12 weeks of pregnancy;
- a lump sum payment upon the birth of a child.

Benefits for pregnant female students
A prerequisite for registration of such payments is the fact that the student is studying at the full-time department of a budgetary educational institution.
In this case, the girl can expect to receive the following types of benefits:
- for pregnancy and childbirth;
- for early registration in a medical institution;
- upon the birth of a child.
The amount of sick leave payment depends on the amount of the scholarship in a particular educational institution, but not lower than the minimum established by law.
For individual entrepreneurs, the payment is charged directly from the FSS budget, provided that all contributions for the past year have been paid.
For the wives of military personnel, there is a special procedure for calculating funds - they will receive a one-time compensation in an increased amount, even if the woman does not officially work.
At the end of the BIR leave, a woman in labor can take leave to care for a child up to 1.5 years old with a payment of 40% of the average salary.
The maximum amount of such an allowance is 28 thousand rubles, but you can only hope for such a payment if you have high earnings.
Students and non-working mothers are entitled to a minimum payment of 4,500 rubles for the first child, and 6,700 rubles for the second and all subsequent children.
