According to Russian law, all women who are preparing to become mothers or who have already given birth to a second child have the right to receive maternity payments. In 2021, the recipients of the allowance are persons working in an enterprise, in an organization of any form of ownership, as well as students who do not have an official place of work.

What is maternity leave

This concept includes two types of vacation, which, although they are combined into one, are issued in different ways. The order of accrual is also different:

  1. Maternity leave. It is drawn up like a regular certificate of incapacity for work, but at the same time its duration is set at the legislative level.
  2. Nursing leave. It is divided into two components: until the baby is one and a half years old (paid) and when the child reaches three years old (paid for certain categories of mothers).

Types of maternity benefits

Legislative acts of the Russian Federation provide for four types of payments designed to ensure the well-being of mothers and children:

  1. One-time compensation. It has a fixed amount (18,004 rubles) and is charged as a one-time payment.
  2. Maternity allowance. The basis for the accrual is a sick leave issued in a medical institution where a pregnant woman is observed. The document indicates the number of days of incapacity for work, which is the basis for calculating the amount of compensation.
  3. Allowance for caring for a child up to one and a half years. Payments are made monthly until the specified age is reached.
  4. Compensation for early registration (within 12 weeks) at a medical facility. Has a fixed amount - 675 rubles 15 kopecks, is of a one-time nature.

How compensation is calculated

The sick leave for pregnancy and childbirth is provided by the local medical institution, while the leave itself is divided into two equal parts (70 days each): prenatal and postnatal periods.

If complications arise during childbirth or immediately after them, the sick leave is extended to 156 days. A mother who has borne and given birth to several babies can count on a vacation, the duration of which is determined at 194 days.

These indicators become fundamental when calculating the benefit, the amount of which is 100% of the salary and is calculated according to the formula: total income for two years × number of days on the certificate of incapacity for work = compensation according to BiR.

If maternity leave falls in 2021, the billing period is set from 2019-01-01 to 2020-01-01.

Since 2020 is a leap year, the "extra" day is also taken into account when calculating the benefit, while the total duration of the estimated terms will be 731 days (365 + 366). Hence, periods when the employee did not work due to previous maternity leave or illness should be excluded.

Minimum allowance

The legislation establishes a minimum and a maximum, the size of maternity payments for the second child cannot be lower or higher than these values. To calculate the minimum amount, the minimum wage is used, which in 2019 amounted to 11,280 rubles, in 2020 - 12,130 rubles.

That is, the average daily earnings in 2019 is 370, 84 rubles, in 2020 - 397, 70 rubles. Thus, a woman in 2021 will receive:

  • for a standard vacation - 53,800 rubles;
  • for difficult childbirth - 59,950 rubles;
  • if several children were born at once, the amount of the allowance will be 74,550 rubles.

The amount may be less than the indicated values only if the working mother worked part-time. Also, when calculating the minimum payment, the employee's work experience is taken into account. If it is less than six months, the amount of the payment is determined by the earnings for the full calendar month.

Maximum payouts

The maximum amount of the benefit does not depend on the minimum wage, but is calculated only on the basis of the employee's average daily earnings for the two years preceding the pregnancy. The maximum base for calculating contributions to the Social Insurance Fund, on the basis of which the maximum amount of payment is established:

  • 2019 - 865 thousand rubles;
  • 2020 - 912 thousand rubles.

Thus, the average daily earnings is 2,431 rubles (865,000 + 912,000/731). For the calculation in 2021, the employee's earnings for 2019 and 2020 are taken. The amount taken into account is 1 million 777 thousand rubles. This means that the maximum amount of compensation in 2021 will be:

  • for standard delivery - 340,340 rubles (2,431 × 140);
  • for complicated childbirth - 379,326 rubles (2,431 × 156);
  • if childbirth ended with the birth of more than one baby, the mother will receive 471,614 rubles (2,431 × 194).

This amount is not subject to indexation and will be valid for the entire 2021 year.

Care allowance

Working and non-working mothers can count on such payments. The peculiarity of this option of state support is that any family member caring for a baby under the age of one and a half years can apply for benefits.

As in the case of maternity allowance for the second child, the amount of care compensation is determined by the minimum wage, as well as the average daily earnings and the maximum basis for calculating contributions to the Social Insurance Fund.

Persons who do not have an official place of work, as well as receive a small salary, can count on an amount of 6,751.54 rubles. The maximum payment for working women is 27,984.66 rubles.

In addition, women whose average per capita family income does not exceed two times the subsistence allowance established in the region of residence are entitled to additional assistance in the form of a monthly child benefit until the child turns three years old.

Recall that earlier the state determined the age limit of 1.5 years. In this case, the second child must be born no earlier than January 1, 2018. Benefits are accrued from maternity capital, that is, you need to be prepared for the fact that the amount of MK will decrease.
