Legislative innovations

At the end of 2020, the Federal Tax Service of the Russian Federation informed citizens about entrusting it with the function of issuing a CEP for legal entities and those who have the right to act on their behalf without receiving a notarized power of attorney. On March 9, the news portal "Interfax" announced the adoption by the State Duma of a bill, in which the new identification procedure was postponed to July 1, 2022. It was previously scheduled for implementation starting in the second quarter of this year 2021.

A. Aksakov, Head of the State Duma Committee on the Financial Market, in his speech informed about the reasons that became fundamental in the adoption of a delay in the implementation of the electronic signature reform:

  • the bill contains strict requirements that reduce the number of certification centers to a minimum;
  • it will take some time to create new, more secure channels;
  • insufficient readiness of business to implement rigid systems of interaction;
  • some issues (for example, options for using a simple and strong signature) need to be improved.

One of the deputies who developed the bill adopted by the State Duma at the end of 2019, A. Izotov, is sure that it was timely. Only the implementation of the digital signature reform will simplify the process of obtaining, exclude CAs with insufficient own funds from it.

What will happen from July 1

From mid-summer this service will be provided free of charge by the Accredited Certification Center of the Federal Tax Service.

Everyone who has the right to obtain a certificate from the Federal Tax Service of Russia must receive it during a personal visit. In this case, there is no possibility of action in the presence of a notarized power of attorney.

A qualified electronic signature in 2021 in Russia will be issued in the following institutions:

  • The Central Bank - to credit institutions, non-credit financial organizations and individual entrepreneurs in its own CA of the Central Bank of the Russian Federation;
  • CA from the Federal Treasury - officials and officials can contact there;
  • CEPs for individuals acting independently or by power of attorney from legal entities will be issued in commercial structures, but only on the condition that they have been accredited and meet the new requirements of the law, and have a sufficient amount of their own funds.

The changes will not affect managers who will be able to use the old electronic signature. Employees and authorized persons will no longer be able to act on behalf of the organization (previously there was such an opportunity, the signature of a legal entity was used, the position and name were indicated). Now they will have to get their own electronic signature, sign documents with it and confirm their credentials.

The signature of the legal entity will be issued only to the heads of the main division or branches. From the beginning of 2022, it will be possible to use signatures that were previously used only in SMEV when it comes to certifying technological documents generated in an automatic system.

The amendments made to Federal Law No. 63 contain higher requirements for certification centers, and their number will decrease regardless of their will and desire. Experts are sure that out of five hundred employees today, only about two dozen meet the set requirements. They continue to work until July 1. It is still possible to obtain new signatures, but they will only be valid for six months. Then you will have to apply again.

So far, not all Russian citizens know what it is, but over time, an urgent need for an electronic signature will be revealed.
