Kokorin and Mamaev: court decision

On October 19, footballers Kokorin and Mamaev, the latest news about whom at the end of 2018 did not leave the front pages of all Russian media, were again brought to trial. This time, the Moscow City Court considered the complaint of the accused, in which their lawyers asked to change the chosen measure of detention, on recognizance not to leave and house arrest.

However, the court found it possible to extend the arrest of 4 accused and left them in a pre-trial detention center until December 9. In addition to the footballers themselves, two more people are involved in the case - Kokorin's younger brother Kirill and their friend Alexander Protosavitsky.

How was the trial

The court decided to consider the appeals of the accused one by one in one room, in which four judges were sitting at once. The accused themselves were not taken to the trial. They participated in it by videoconference while in the pre-trial detention center.

Despite the absence of Kokorin and Mamaev in the court, many people gathered in the hall, as the latest news about the scandalous behavior of football players in 2018 stirred up all sectors of society.

Pavel Mamaev was the first to answer the judge's questions on the monitor. His line of defense was the same. In all likelihood, the lawyer recommended that he insist that he did not take part in the fight, so the article on hooliganism cannot be applied to him. Also, the defendant's lawyer mentioned that Mamaev actively cooperated with the investigation and publicly repented, offering the injured party to compensate for the damage caused.

The defense lawyer argued that Mamaev was not going to hide from law enforcement agencies, so he could be released on bail. He immediately handed over all his passports to the investigator.

Mamaev himself pointed out that during a confrontation with the victim, an official from the Ministry of Industry and Trade, Denis Pak, it was established by the investigation that the victim had no complaints against Mamaev.

The lawyer also pointed out what negative consequences the detention can bring for his client. Let's list the main ones:

• harm to health when kept for a long time in the confined space of the isolator;
• loss of fitness without regular training;
• early termination of the contract with the football club, as a result of which the client's source of permanent official income will disappear;
• harm to the health of one of the children of Mamaev, who, due to illness, needs the care of his father at this stage.

The next was Kokorin's younger brother, Kirill. His lawyer drew attention to his youth and characterized him as a "house child" who was not used to hearing public insults.

The greatest impression on those present was made by the defense of Alexander Kokorin. Unlike Mamaev, she was represented by several lawyers at once. They submitted to the court letters from the head of the football club in which Kokorin plays, and appeals from famous athletes, who were forced to defend their colleague by the latest news about the loudest sports scandal of 2018 in Russia.

Kokorin promised to compensate the material damage to the victims and apologized for what he had done. However, during his speech, he received a remark from the judge, like Mamaev, that even at a teleconference it was impossible to answer the judge while sitting.

The footballer's lawyers indicated that his mother was ready to pay a deposit of 10 million rubles for her son.

The latter considered the appeal of a friend of the Kokorins, Alexander Protosavitsky. At that moment, there were almost no journalists in the courtroom, since the fate of the football coach of the children's team from Podolsk was not interesting to many of the press.

The defendant's lawyer pointed out that he was the only breadwinner in the family and that he alone was raising a 9-year-old daughter, and his retired parents could not post bail for him.

Protosavitsky himself asked the judges to let him go to his child's birthday and pointed out that the victims had no complaints against him, since he tried to keep them from getting into conflict, and did not strike.

The statements of the prosecution that he will be able to escape at large using the money of Kokorin and Mamaev, he considers absurd. Alexander pointed out that he has nothing to do with other people's money.

Decision of the Moscow City Court

Despite the large number of arguments prepared by the defendants' lawyers, all the judges unanimously left the previous punishment for all the accused and rejected their appeals. Well-known lawyers explained such a court decision by the fact that the press created a negative atmosphere in society.

According to the law and legal practice, if the accused have not previously committed serious offenses, are first brought under the article “Hooliganism” and have not inflicted serious injuries on the victims, then it is pointless to keep them in custody.
