With the introduction of the pension reform in the Russian Federation, a new status has appeared, which is assigned to people of pre-retirement age. According to the legislation of the Russian Federation, benefits for pre-retirees in 2021 will be assigned upon reaching a certain age: 53 years (for women) and 58 years (for men).
What are the benefits for pre-retirees in 2021
The types of benefits provided to pre-retirees can be conditionally divided into the following categories:
- in the sphere of labor and employment;
- tax;
- others (alimony, mandatory share in the inheritance).
The list of benefits is enshrined in the legislative acts of the Russian Federation (state and regional). For this reason, the procedure and conditions for their provision differ, including by age criteria and territory of residence.
Support measures in the sphere of labor and employment
Citizens who have reached the pre-retirement age have the right to count on additional guarantees in the field of employment. These include:
- increasing the maximum unemployment benefit;
- the provision of days off for undergoing medical examination;
- protection against unjustified dismissal;
- retraining.
Unemployment benefits
For persons of mature age, there is a special procedure for applying for and receiving unemployment benefits. The minimum payout is 1,500 rubles, the maximum is 12,130 rubles. The period for issuing benefits is determined depending on the date of dismissal and length of service.
If less than 12 months have passed since the dismissal, the payment is made within a year according to the following scheme:
- year - compensation;
- 6 months - break;
- year - compensation.
At the same time, citizens who have worked for 25 years (men) and 20 years (women) will receive benefits for 24 months according to the scheme:
- 2 years - payment;
- year is a break.
Extra days off
Employees with pre-retirement status are entitled to use 2 additional days off per year for medical examination. The periods are agreed in advance with the management, and at the end of the procedures, the employer is provided with supporting documents issued by the medical institution (extracts, certificates).
Unjustified dismissal
The employer bears criminal responsibility for refusing to hire citizens of this category, as well as for their unjustified dismissal. The norm is enshrined in the Criminal Code of the Russian Federation (Article 144).
An employee of pre-retirement age does not have any advantages over other employees if the termination of an employment contract is made due to a reduction in staff.
In addition, the employer is exempt from liability in the following cases of termination of employment:
- expiration of the contract;
- Liquidation of company;
- violation of labor discipline or improper performance by an employee of professional duties.
Retraining
Individuals wishing to improve their professional skills are given the opportunity to enroll in free courses. In this case, the fact of the presence / absence of employment does not matter. Such courses are organized by the Employment Center.
Those who study on a full-time basis are entitled to a scholarship. The duration of training is on average 3 months, the program is determined depending on the specialization. Retraining courses allow you to raise the level of knowledge in the existing specialty, to master new technologies.
Preferential taxation
The pre-retirement tax preferential program was launched in 2019. Benefits are provided both at the regional and federal levels.
Federal preferences include:
- Exemption from paying taxes on one type of property owned by a citizen on the basis of property rights. It can be an apartment or a share in it, a residential building or part of it, a room, an outbuilding, a parking lot, a garage, or another building.
- Land tax exemption. The area of the plot should not be more than 6 acres (600 m²).
The Tax Code provides for a special procedure for the provision of these benefits. Citizens who meet the criteria established for the appointment of a pension in accordance with the legislation in force in December 2018 have the right to receive them. These are persons who have reached the retirement age according to the old standards - 55 years (for females) and 60 years (for males) or the age for early retirement.
Other privileges
Most often, pre-retirees are equated with retirees and are endowed with similar rights.
Right to alimony
According to the law, adult children of citizens of retirement and pre-retirement age are obliged to provide parents, including financially. The initiative is still at the stage of approval by the authorities. The provisions of the bill No. 548974-7 concern pre-retirees who have lost their jobs and need help.
Allocation of a share of inheritance
Previously, only a disabled or minor relative could legally inherit after the deceased, even if he is not mentioned in the will of the deceased. Now this list also includes pre-retirees.
Funded pension
A citizen acquires the right to receive the funded part of his pension upon reaching the age of 60 (for men) and 55 (for women). Funds can be transferred in one of the following ways:
- monthly payments;
- one-time transfer of the entire accumulated amount;
- urgent deductions.
The latter option is chosen by those who wish to receive a fixed amount. In this case, the savings are divided by a certain number of months (maximum 120), during which payments will be made.
A lump sum payment is made on the condition that the total amount of the pension is 5% (maximum) of the amount of the insurance part. Payment formula: total accumulated amount divided by 252 months. If the result exceeds 5%, the citizen can receive the total amount on a monthly basis until the moment of death.
Regional benefits
Certain regions provide additional support to citizens of pre-retirement age, endowing them with certain privileges. So, at the level of the constituent entities of the Russian Federation, the following benefits are established:
- reimbursement of expenses for payment of utility services;
- land tax discounts;
- exemption from payment of transport tax;
- subsidies for media and communications;
- free travel in public transport;
- provision of vouchers to sanatoriums, dispensaries;
- free medical examination;
- targeted assistance.
How to apply for benefits
The main part of the privileges is formalized in the social security authorities or the MFC, where the applicant must appear with an application and passport. To obtain tax benefits, it is necessary to submit to the Tax Authority a certificate that can confirm the status of the applicant.
You can get the document at the PFR branch at the place of residence or through the electronic resource of the same department. This requires:
- Register on the portal of public services.
- Go to the official website of the PFR, located at www.pfrf.ru and log in there using the portal account.
- Open the section "Pensions", find the option "Order a certificate / statement", go to the tab "On assigning a citizen to the category of citizens of pre-retirement age".
- Indicate the parameters of the request: the name of the institution where the certificate should be presented (FTS, employer and others), indicate the desire to receive the finished file to the specified e-mail address.
- Upon completion of the procedure, click the "Request" button. In the window that appears, select "Call history" and save the document, then - "Help in PDF format".
The document is drawn up by the FIU free of charge at the request of a citizen. The finished document is sent to the applicant within three working days.
Outcomes
Those who have reached the pre-retirement age can count on a range of privileges in the areas of taxation, social protection and employment. The main part of the benefits is issued at the CPC if you have a passport. The tax office will additionally require a certificate confirming the applicant's status. You can draw up a document when visiting the FIU or through the department's website.
